Changes to the Federal Rules of Civil Procedure - Computer Forensics and E-Discovery

On December 1, 2006, many amendments to the Federal Rules of Civil Procedure went into effect. There are three rules specifically that impact Computer Forensics and E-Discovery which need to be considered when building a case for your client, as well as protecting your client's rights.

Most companies fail to realize the following two points:

• Any data that can be compiled into viewable form, whether presented electronically or printed on paper, is potentially within the definition of ?document".

• Electronic documents may be considered obsolete by the business in terms of its current computer infrastructure, but may have archival value and be recoverable to a readable format by specialized forensic techniques.

FRCP - Rule 26 (LII 2007 ed.)

With the new law regarding E-Discovery now in place, Rule 26a1 changes are very important.

At the first sign that litigation is coming, a company must use their Litigation Hold procedures and not wait for the courts to act. The problem is most companies do not have these procedures in place, nor do these companies know that litigation holds must start this early in the process.

Of course in order to have Litigation Hold Procedures, a company must have a retention policy and know where the company's data is stored and must be easily accessible.

Rule 26. General Provisions Governing Discovery; Duty of Disclosure

Except in categories of proceedings specified in Rule 26(a)(1)(E), or to the extent otherwise stipulated or directed by order, a party must, without awaiting a discovery request, provide to other parties:

(A) the name and, if known, the address and telephone number of each individual likely to have discoverable information that the disclosing party may use to support its claims or defenses, unless solely for impeachment, identifying the subjects of the information;

(B) a copy of, or a description by category and location of, all documents, electronically stored information, and tangible things that are in the possession, custody, or control of the party and that the disclosing party may use to support its claims or defenses, unless solely for impeachment.

FRCP - Rule 34 (LII 2007 ed.)

With the new law regarding E-Discovery now in place, Rule 34 identifies new procedures regarding the production of documents and electronic data for litigation.

Rule 34. Production of Documents and Things and Entry Upon Land for Inspection and Other Purposes

(a) Scope.

Any party may serve on any other party a request (1) to produce and permit the party making the request, or someone acting on the requestor?s behalf, to inspect, copy, test, or sample any designated documents or electronically stored information ? including writings, drawings, graphs, charts, photographs, sound recordings, images, and other data or data compilations stored in any medium from which information can be obtained ? translated, if necessary, by the respondent into reasonably usable form, or to inspect, copy, test, or sample any designated tangible things which constitute or contain matters within the scope of Rule 26(b) and which are in the possession, custody or control of the party upon whom the request is served; or (2) to permit entry upon designated land or other property in the possession or control of the party upon whom the request is served for the purpose of inspection and measuring, surveying, photographing, testing, or sampling the property or any designated object or operation thereon, within the scope of Rule 26(b).

FRCP - Rule 45 (LII 2007 ed.)

With the new law regarding E-Discovery now in place, Rule 45 identifies new procedures to follow when your company subpoenaed.

Rule 45. Subpoena

(d) Duties in Responding to Subpoena.

(1)(A) A person responding to a subpoena to produce documents shall produce them as they are kept in the usual course of business or shall organize and label them to correspond with the categories in the demand.

(1)(B) If a subpoena does not specify the form or forms for producing electronically stored information, a person responding to a subpoena must produce the information in a form or forms in which the person ordinarily maintains it or in a form or forms that are reasonably usable.

Computer Upgrade - DVD-ROM Required for Microsoft's Vista

Microsoft?s Vista is so large the company was forced to issue it on DVD. There are a generation of computers that have at least the minimum necessary processor and system memory, but were sent from the factory with a CD burner. People owning these machines will have to upgrade to a CD/DVD, or stick with Windows XP.

Installing a CD/DVD is a simple task that can be done in less than 30 minutes. There?s no need to send the unit to a repair shop. All that is required is a screwdriver and a little common sense.

The CD burner will have 3 cables running to it; a power cable, a ribbon cable, and a sound cable. These must be disconnected.

Four screws hold the CD-ROM in place, two on each side. Take these loose with a Phillips screwdriver. The unit can then be slid out the front of the case.

Installing the new CD/DVD is essentially the reverse of taking out the old unit. But before you install it, check to make sure the jumpers on the new unit are set to match the old one. For instance, if the old drive had the jumper set to ?slave?, the new one should be set to ?slave? as well.

Now slide the CD/DVD in the front of the case, and station it there with the four screws you removed earlier.

Re-attach the cables. Start with the sound cable, because it is the hardest to reach. It will be plugged in with its white wire turned toward the center of the unit.

The IDE ribbon cable is next. You will notice there is one blank spot in the plug. This blank matches a missing pin in the CD/DVD?s cable port, preventing you from plugging it in the wrong way.

The power cable, usually a Molex D, will only fit one way. So it is impossible to connect backwards.

With everything connected, you are ready to boot up. When you do, XP?s Plug and Play feature will tell you ?New Hardware Found?, and load a standard driver.

You?re in business, ready to install Vista.

We all take the computer for granted. I mean, all we have to do is switch it on and it's ready to go. But did you ever stop to think what would happen if your computer suddenly crashed? And that is the only computer you have to work on!

What will happen to your work and your business for the next few days or weeks?

Do you have the original or a copy of all your programs?

Do you have the setup configurations, eg for your ISP?. You will need this to re-install some programs.

Do you have a copy of your email address book? Your email list or address book is vital to your business.

Do you remember all your passwords - for retrieving email, connecting to your ISP, membership sites, etc?

So what can you do to ensure that your computer will run as well as you'd expect, and continue working when your computer is down? Here's a few simple tips:

1.Is your computer protected from viruses? Install an anti-virus software such as Norton AntiVirus or McAfee, and make sure to get regular updates. New viruses are coming out more often these days so you need to have updates regularly. Anything more than 3 months old needs to be updated today.

2.Install a firewall. Anytime your computer is connected to the Internet without a firewall, it is operating under an "open door" policy to intruders. Hackers can get in, take what they want, and even leave open a "back door" so they can turn your computer into a "zombie" and use it to attack other computers, distribute porn and spam.

Your bank account and credit card information, passwords, documents and personal files can be stolen while you're busy surfing. Don't let that happen!

3. Make regular backups of your important files. Keep a record of all vital information, such as passwords, system configurations, etc. in a file and also print a copy of this and keep in a safe place. Make a duplicate and keep at another location.

If your computer does not come with a zip drive or CDRW drive, it would be a good idea to invest in one. Zip drives and CDRW drives are inexpensive and can be easily installed. The cost of a blank CD for example is less than $1.00 and can store up to 650MB of data.

If you lost some files or your hard disk crashed you can easily retrieve them from the backups. And if your computer is down for repair, you can take that backup CD and work from another machine.

4.Remove all unwanted files on your hard disk. You can safely remove files in your temporary internet folder. In Internet Explorer, select Tools -> Internet options - > Delete Files.

5.Increase your systems performance by defragmenting your hard disk regularly. As applications and files are saved and deleted they gradually cause your hard disk to fragment. By defragmenting your hard disk you can optimise the performance of your computer. Defragmenting may also save wear and tear on your hard disk and extend its lifespan.

I'm one of those people who loves a bargain. I spend hours rummaging around in junk shops, charity stores, jumble sales and discount outlets. After playing with computers, it's probably one of my favourite relaxations. And browsing around for discounted computer kit is the best of both worlds. I just love it. But I don't do my digging in walk-in stores. When I'm looking for computer kit, I do my bargain-hunting online.

Buying a discount or surplus computer on the net is not as scarey as you might think. You don't have to trust yourself to unknown and faceless vendors on certain auction sites - we've all heard the horror stories of customers allegedly sending money and getting nothing in return. A young man in the UK was recently jailed for defrauding ebay customers of more than ?300,000 -- over $500,000. The problem is, when you buy from a private seller you lose many of your rights, because the Sale of Goods Act only applies to purchases from recognised dealers, not Mr Jones or Mrs Smith round the corner.

Then there are online or mail order discount stores. Some of these have also disappeared without trace after seeming to offer much value for little expense. And again, it's the poor customer who has lost out. And there are a number of suppliers well known to Watchdog viewers for offering great deals - that turn out to be less great once the goods arrive.

But it doesn't have to be like this.

There are dealers which have been going for long enough, and with a broad enough customer base, to have built up a reputation for quality and reliability. Some of them are retailers of long standing who were favourites of us geeks long before the internet existed, now trading online. Others have been trading on the net for many years, and built up their reputation in that way.

I remember visiting Morgan Computers' shop in the mid eighties. I think it was in Tottenham Court Road, or perhaps the shabby end of New Oxford Street. Anyway, it was a veritable treasure trove for the computer enthusiast - you never knew what you would find, and you were almost always guaranteed to find something exciting. These people weren't (and aren't) just dealers; they actually knew about their products. You could ask them questions about the capabilities of the machines, and get meaningful answers - which was a pretty rare thing in those days.

Nowadays, Morgan Computers are one of Europe's leading dealers in surplus, end-of-line and refurbished computer equipment. Established over 15 years they have four retail locations and a flourishing website; the site offers a full range of equipment with simple secure online ordering, stocks and prices reviewed daily, a bargain basement section and weekly stock updates by email. What they do is search the net for you, bringing together all the best prices for the product you are searching for, providing links to the approproate supplier in each case. For example, recently I used them to find myself a replacement mobile after mine fell out of my pocket on the bus (duh!) - and I got a real bargain. One of my favourite sites for drooling, even when I don't have any specific purchase in mind!

I'm not going to tell you to buy your next computer from a discount supplier, only you can make that decision. But I hope I have at least given you some options to make your decision as to whether to take the plunge a little less worrying.
